Fiber Optic Easement
Travis County – Smith School Road

I. DISCUSSION: A private communications company has purchased a building adjacent to the Department’s Austin headquarters and has requested a permanent easement along Smith School Road to install a fiber optic cable. The easement would be approximately 2000 feet in length and 5 feet wide for a total of 10,000 square feet. In order to allow installation to proceed, the company was issued a Construction Permit and Certificate of Occupancy for a period of 10 years, with a provision for conversion to a permanent easement, contingent on Parks and Wildlife Commission and Parks and Wildlife Board for Lease approval. Compensation for the easement is $45,000 ($4.50 per square foot). Department staff have examined the application and concluded there is no feasible or prudent alternative to the use of the easement and the project includes all reasonable planning to minimize harm to the land.

II. RECOMMENDATION: The staff recommends the Texas Parks and Wildlife Commission adopt the following motion:

"The Executive Director is authorized to recommend to the Board for Lease for Parks and Wildlife Lands the granting of an easement to Applicant as requested, incorporating the terms and conditions shown in Exhibit A."
