Rule Review–Adoption of Completed Rule Review Chapter 58

I. Executive Summary: Section 2001.039 of the Texas Government Code requires state agencies to review each rule under its jurisdiction at least once every four years. Staff has completed this review and is not recommending any changes to Chapter 58. As a result of this review, Texas Parks and Wildlife Department (TPWD) staff is requesting that the Texas Parks and Wildlife (the Commission) adopt the completed review of Chapters 58, Oysters and Shrimp.
II. Discussion: In January 2010, the Commission authorized Texas Parks and Wildlife Department (TPWD) staff to review Chapter 58, Oysters and Shrimp, in Title 31, Part 2 of the Texas Administrative Code, and to publish any required changes as part of the Statewide Hunting and Fishing Proclamation. Notice of the review of Chapter 58 was published in the Texas Register on February 12, 2010 (35 Tex. Reg 1303). Staff is recommending no changes to Chapter 58 as a result of the review.
III. Recommendation: TPWD staff recommends that the Texas Parks and Wildlife Commission adopt the following motion:
“The Texas Parks and Wildlife Commission adopts the completed rule review of Chapter 58, Oysters and Shrimp, of the Texas Parks and Wildlife Department rules (Title 31, Part 2 of the Texas Administrative Code) as published in the Texas Register on February 12, 2010 (35 Tex. Reg 1303).”
