Resolution - East Texas Fish Hatchery
November 2004

I. Executive Summary: The Texas Parks and Wildlife Foundation, Inc. (Foundation) entered into an agreement with the Department to solicit for a site and best value for the new East Texas Fish Hatchery. Seven entities responded to the Foundation's Request for Proposals and were evaluated. The Foundation utilized technical advisors from within the Department as well as commercial engineering firms to assess technical merits and an independent certified public accounting firm to assess the value-added aspects of each offer. The Foundation will present its findings to the Commission.

II. Recommendation: The staff recommends the Commission adopt the following motion:

"The Texas Parks and Wildlife Commission approves the resolution as shown in Exhibit A to support the Foundation's suggested site, direct the Department to move forward to formalize and execute the agreement contingent upon all conditions being met and to thank the Foundation for its successful efforts."

A Resolution by the Texas Parks and Wildlife Commission Regarding the Recommendation of the Texas Parks and Wildlife Foundation for the Site of the New East Texas Fish Hatchery

Whereas, the Texas Parks and Wildlife Foundation, Inc. (Foundation) has solicited on behalf of the Department a gift of real property to be utilized as, and other assistance to be utilized for, a site for a new East Texas State Fish Hatchery; and

Whereas, the Foundation has thoroughly and carefully evaluated proposals from seven entities willing to provide a gift of real property and other assistance, and

Whereas, the Foundation recommends that the offer of Jasper County valued at approximately $28 million in water, land and other gifts be accepted, specifically conditioned upon the execution and satisfaction of the terms and conditions to be contained in an agreement between the Department and Jasper County to effect the gift or offer.

Now, therefore, be it resolved that the Texas Parks and Wildlife Commission hereby accepts the recommendation of the Foundation for the proposed offer of a site for the new East Texas State Fish Hatchery and other assistance contained in said offer.

And be it further resolved that such offer is accepted, conditioned specifically upon the prior execution and satisfaction of all those certain terms and conditions to be contained in an agreement between the Department and Jasper County that are necessary to effect such gift or offer.

AND BE IT FURTHER RESOLVED that the Texas Parks and Wildlife Commission gratefully acknowledges the work and dedication of the Foundation to provide its recommendation for the new East Texas Fish Hatchery and secure the best value for the Department and, ultimately, the freshwater anglers of Texas.
