Acquisition of Outstanding Property Interests
Tom Green County
San Angelo Fish Hatchery

I. Executive Summary: Texas Parks and Wildlife Department (TPWD) staff recommends that the Commission authorize the Executive Director to take all actions necessary to acquire the outstanding property interests at the former San Angelo Fish Hatchery in Tom Green County.
II. Discussion: By deed, dated September 1, 1928, twelve individuals transferred 60 acres of real property in Tom Green County to the Game, Fish and Oyster Commission of Texas, the predecessor of TPWD. The deed stated that the property was to be used "for the construction, erection, maintenance and operation of a State Fish Hatchery." The deed further stated that "if after the establishment of such Hatchery at any time within the future said premises be abandoned for Fish Hatchery purposes for as long a term as one year then this grant shall cease and terminate and said premises shall revert to the grantors hereof, their heirs, legal representatives and assigns." The property has not been used as a hatchery for a number of years. TPWD has acquired all or part of the interests of three of the original grantors. Staff will be recommending that the Commission approve the following motion.
III. Recommendation: Staff recommends that the Commission approve the following motion:
"The Texas Parks and Wildlife Commission authorizes the Executive Director to take all necessary steps to acquire the outstanding interests in the property formerly used as the San Angelo Fish Hatchery in Tom Green County."
