Land Sale – Brown County
Approximately 19 Acres at Muse Wildlife Management Area

I.       Executive Summary:  Texas Parks and Wildlife Department (TPWD) staff is seeking to sell approximately 19 acres of land at the Muse Wildlife Management Area (MWMA).

II.     Discussion: The MWMA consists of 1,972.5 acres in Brown County acquired by donation with the stipulation that it be managed for wildlife. The operation of MWMA includes the development and management of wildlife habitats and populations of indigenous and migratory wildlife species. MWMA also provides areas to demonstrate habitat development and wildlife management practices to landowners and other interested groups; develop new techniques for managing wildlife populations and habitat through on-the-ground research designed for local issues and conditions; and to provide public hunting.

The donation tract includes approximately 19 acres tract of land that lies across a county road from the main body of the MWMA, which makes management of this small disconnected tract difficult and impractical. There have been many problems caused by this tract that include vandalism, trespass and littering/dumping of trash.

III.       Recommendation:  The staff recommends the Texas Parks and Wildlife Commission consider the following motion:

“The Commission adopts the Resolution attached as Exhibit A.”

A Resolution by the Texas Parks and Wildlife Commission Regarding the Land Sale Approximately 19 Acres at Muse Wildlife Management Area in Brown County

Resolution

Whereas, Texas Parks and Wildlife Department (TPWD) owns the McGillivray and Leona McKie Muse Wildlife Management Area (MWMA) located in Brown County, 15 miles Northeast of Brownwood, Texas East of U.S. Highway 183 and north of F.M. 1467 on CR 478; and,

Whereas, MWMA was donated to TPWD by McGillivray and Leona McKie Muse to be managed as a wildlife management area; and,

Whereas, TPWD management of the 1972.5 acre MWMA includes the development and management of wildlife habitats and populations of indigenous and migratory wildlife species and also provides areas to demonstrate habitat development and wildlife management practices to landowners and other interested groups, develop new techniques for managing wildlife populations and habitat through on-the-ground research designed for local issues and conditions and for public hunting; and,

Whereas, approximately 19 acres of the MWMA is disconnected from the main body of the wildlife area, being separated by a county road; and,

Whereas, this separation makes management of this small disconnected tract difficult and impractical because of its small size and problems caused by vandalism, trespass and littering/dumping of trash; and,

Whereas, trying to police this small tract takes a good deal of staff time that could be better spent on management of the main part of the MWMA; and,

Whereas, TPWD would sell the 19 acre tract with the strict condition that it be managed under a Wildlife Management Plan (PLAN) provided and overseen by TPWD; and,

Whereas, the PLAN would prohibit construction of any buildings on the 19-acre sale tract; and,

Whereas, the Texas Parks and Wildlife Commission (the Commission) finds that as required by Parks and Wildlife Code, Chapter 26, notices of today’s hearing of this matter were published at least once a week for three consecutive weeks in a newspaper of general circulation which is published at least six days a week in the community nearest to the MWMA in which such newspapers are published (Brownwood Bulletin) with the last day of publication being not less than one week or more than two weeks before the date of today’s hearing and that such notices specified the date and time at which the Commission would hear testimony regarding the proposed sale; and,

Whereas, the Commission finds, in accordance with Parks and Wildlife Code, Chapter 26, that there is no feasible and prudent alternative to the sale of such land subject to the restrictions on use described herein; and,

Whereas, the Commission finds, in accordance with Section 13.009 of the Texas Parks and Wildlife Code that sale of the 19-acre tract is in the best interest of TPWD; and,

Now, therefore, the Commission authorizes the Executive Director to take all necessary steps to sell the 19-acre tract subject to the conditions described herein and in the motion approving this Resolution.
