McKinney Falls State Park

I. Executive Summary: Texas Parks and Wildlife Department Staff (TPWD) has a request from the City of Austin to purchase a 0.711 acre tract of land.

II. Discussion: TPWD has a request from the City of Austin to purchase a 0.711 acre tract (Tract) of land that is part of McKinney Falls State Park (Park). The tract is also part of an 8 acre tract that was separated from the main body of the Park by the extension of Stassney Lane. The tract lies within the banks of Williamson Creek and is entirely within the 100-year flood plain. The City plans on using the tract as part of a drainage project along Williamson Creek. The 8 acre tract has been deemed as underutilized by the General Land Office.

III. Recommendation: The staff recommends the Texas Parks and Wildlife Commission adopt the following motion:

"The Texas Parks and Wildlife Commission adopts by Resolution in Exhibit A, the provisions of this land sale at McKinney Falls State Park."

A Resolution by the State of Texas Parks And Wildlife Commission Regarding the Sale of a 0.711 Acre Tract of Real Property at Mckinney Falls State Park in Travis County

Resolution

Whereas, Texas Parks and Wildlife Department (TPWD) staff have recommended that the Texas Parks and Wildlife Commission (Commission) approve a transaction to sell a 0.711 acre tract (the Tract) at McKinney Falls State Park (the Park) to the City of Austin for appraised value;

Whereas, the Tract is separated from the main body of McKinney Falls State Park by a major road, Stassney Lane, and provides no recreational or natural resource value to the Park;

Whereas, Commission finds, in accordance with Chapter 26 and Section 13.009 of the Texas Parks and Wildlife Code that (1) ownership of the Tract is no longer in the best interest TPWD; (2) there is no reasonable and prudent alternative to the sale of the Tract to the City of Austin; and (3) the sale of the Tract includes all reasonable planning to minimize harm to the Tract.

Now, therefore, the Texas Parks and Wildlife Commission authorizes the Executive Director to take all necessary steps to sell the tract to the City of Austin for appraised value.

Adopted and approved this 28th day of January 2010.
