Implementation of Legislation Passed During by the 84th Texas Legislature – Senate Bill 1978 – Designation of Nonprofit Organization to Receive Donations Made By Persons when Purchasing a Hunting License for a Statewide Program to Provide Hunters a Way to Donate Legally Harvested Deer to Local Food Assistance

I.          Executive Summary: This item designates a non-profit organization to receive donations made by persons when purchasing a hunting license for a statewide program to provide hunters a way to donate legally harvested deer to local food assistance providers.

II.        Discussion: SB1978 by Senator Lucio allows for a voluntary contribution to a non-profit organization to help feed hungry Texans when a person applies for a hunting license. The non-profit as designated by the Commission must administer a statewide program that provides hunters with a way to donate legally harvested deer to local food assistance providers.

III.       Recommendation: The staff recommends the Texas Parks and Wildlife Commission adopt the following motion:

"The Texas Parks and Wildlife Commission adopts the resolution attached as Exhibit A."

Designating a Nonprofit Organization to Receive Donations Made By Persons when Purchasing a Hunting License for a Statewide Program to Provide Hunters a Way to Donate Legally Harvested Deer to Local Food Assistance

Resolution

Whereas, the 84th Texas Legislature (Regular Session, 2005), enacted Senate Bill (SB) 1978 to add Section 42.011 to the Texas Parks and Wildlife Code;

Whereas, new Section 42.011 provides that when a person applies for a hunting license, the person may contribute $1 or more to a nonprofit organization designated by the Texas Parks and Wildlife Commission (the commission);

Whereas, the designated nonprofit organization’s purposes must include the administration of a statewide program that provides hunters with a way to donate legally harvested deer to local food assistance providers;

Whereas, the statewide program administered by the designated nonprofit organization must include the recruitment of meat processors who, for a nominal fee to cover processing costs, process and package the venison and contact the food assistance providers to pick up the venison;

Whereas, Section 2 of SB 1978 requires that by September 15, 2015, the Texas Parks and Wildlife Commission (the Commission) designate a nonprofit organization to receive donations under new Section 42.011;

Whereas, the Texas Parks and Wildlife Department (TPWD) posted a notice on its main Internet web site titled “Invitation to Nonprofit Organizations: Hel Hunters feed the Hungry!” and a link to an application;

Whereas, TPWD staff received and carefully reviewed all applications submitted in response to the notice;

Whereas, TPWD staff have determined that the entity named below meets the criteria established in Texas Parks and Wildlife Code §42.011, as added by SB 1978;

Whereas, TPWD staff has recommended that the Commission designate the entity named below as the nonprofit organization to receive donations made by persons when purchasing a hunting license for a statewide program to provide hunters a way to donate legally harvested deer to local food assistance; and,

Now, therefore, the Texas Parks and Wildlife Commission designates [NAME OF ENTITY TO BE DESIGNATED] as nonprofit organization to receive donations made by persons when purchasing a hunting license for a statewide program to provide hunters a way to donate legally harvested deer to local food assistance.

In official recognition of the adoption of this resolution in a lawfully called public meeting of the Texas Parks and Wildlife Commission, we hereby affix our signatures this 20th day of August 2015.
