Action Disposition of Real Estate - Williamson County
House and Lot in Florence, Texas

I.      Executive Summary: Texas Parks and Wildlife Department (TPWD) was bequeathed a house and lot in Florence, Texas which may be sold with the funds becoming land sale proceeds for the State Parks Division.

II.     Discussion:  A house and lot in Florence, Texas has been left to TPWD by Mr. Kenneth Stiles. According to Mr. Stiles’ will, the purpose of the bequest is “management and conservation of the natural resources of Texas, including youth programs for youth to enjoy such natural resources.”  The house and lot do not meet any of the criteria for inclusion in the TPWD land inventory. On May 25, 2016, the Texas Parks and Wildlife (TPW) Commission authorized staff to solicit public input regarding possible disposition of the tract. Staff has worked with a local broker to establish fair market value and market the tract. The land sale proceeds from the house and lot will be strategically applied toward the acquisition of state park priority land consistent with Mr. Stiles’ intent.

III.   Recommendation:  The staff recommends the TPW Commission adopt the following motion:

“The TPW Commission adopts the Resolution attached as Exhibit A.”

A Resolution by the Texas Parks and Wildlife Commission Regarding the
Disposition of a House and Lot in Florence, Texas in Williamson County

Resolution

Whereas, a house, consisting of an uninhabitable single-wide mobile home, and a tract of land (lot) of approximately a quarter-acre (the Property), were left to Texas Parks and Wildlife Department (TPWD)  in 2009 in the will of Mr. Kenneth Stiles; and, 

Whereas, the Property has no possible recreational or operational value to TPWD, and the continued ownership of the Property is not in the best interest of TPWD; and,

Whereas, Mr. Stiles stipulated in his will that the purpose of the bequest was “management and conservation of the natural resources of Texas, including youth programs for youth to enjoy such natural resources;” and,

Whereas, staff finds that sale of the Property and use of the proceeds from the sale to help acquire strategic state park land is consistent with Mr. Stiles’ intent and bequest; and,

Whereas, on May 25, 2016, the Texas Parks and Wildlife Commission (TPW Commission) authorized TPWD staff to begin the public notice and input process regarding the proposed sale of the Property; and,

Whereas, TPWD retained the services of a broker to establish fair market value for the Property and market the Property; and,

Whereas, TPWD has received a fair market offer and a Contract of Sale for the Property pending Commission authorization; and,

Whereas, the TPW Commission finds that as required by Texas Parks and Wildlife Code, Chapter 26, notices of today’s hearing of this matter were published at least once a week for three consecutive weeks in a newspaper of general circulation which is published at least six days a week in the community nearest to the Property in which such newspapers are published (Austin American Statesman in Travis County), with the last day of publication being not less than one week or more than two weeks before the date of today’s hearing and that such notices specified the date and time at which the TPW Commission would hear testimony regarding the transfer; and,

Whereas, the TPW Commission finds, in accordance with Section 13.009 of the Texas Parks and Wildlife Code that sale of the Property is in the best interest of TPWD; and,

Now, therefore, the Texas Parks and Wildlife Commission authorizes the Executive Director to take all necessary steps to sell the Property for the purposes and subject to the conditions described herein and in the motion approved in this Resolution.

Adopted and approved this 25th day of January, 2018.
